Chulin 95

CHULIN 92-95 - Sponsored by a generous grant from an anonymous donor. Kollel Iyun Hadaf is indebted to him for his encouragement and support and prays that Hashem will repay him in kind.

1)

(a) What did 'Shimon' reply when 'Reuven' told him that had he made up with him, he would have given him a piece of meat from the fat ox that he had Shechted on the previous day?

(b) What was Reuven's response to that?

(c) What did Rebbi comment on this incident? Why did he refer to Reuven as a fool?

(d) We explain that Rebbi follows his own reasoning.
What did he say about a town where the majority of Shochtim and of butcheries are Jewish?

2)
(a) What did Rebbi say, according to the second Lashon? What reason did he give for not forbidding all the meat in the butcheries that day?

(b) What can we infer from there?

(c) How do we reconcile this with Rebbi's ruling, permitting all the meat in a town where the majority of the Shochtim and the butchers are Jewish?

3)
(a) On what grounds does Rav render Asur, meat that was out of sight for a short while ('Basar she'Nis'alem min ha'Ayin')?

(b) Will this Isur apply even to meat that one leaves in one's house?

(c) How do we reconcile Rav's ruling with Rebbi's previous statement, permitting meat that is found in the hands of a Nochri?

4)
(a) In a town that has nine Kasher butcheries and one Tereifah one, the Beraisa forbids a piece of meat that one purchases from a butchery, and cannot recall from which one he purchased it.
Why do we not go after the majority of butcheries?

(b) In which case will the Tana permit the piece of meat?

(c) In the latter case, why does the Tana not forbid it because of 'Basar she'Nis'alem min ha'Ayin'?

5)
(a) What does the Mishnah in Machshirin say about raw meat that one finds in a town which boasts a majority of Kasher butcheries?

(b) What does the Tana say about a case where the meat is cooked?

(c) What would be the problem with establishing the Reisha of this Mishnah where the meat was found in the hands of a Nochri (in order to accommodate Rav)?

(d) So how do we finally accommodate Rav? How do we establish both the Reisha and the Seifa?

6)
(a) The Mishnah in Shekalim discusses Basar that one finds outside the Beis Hamikdash. What does the Tana say there where one finds ...
  1. ... whole limbs?
  2. ... limbs that have been cut into pieces (assuming that the majority of Shochtim are Jewish)?
(b) To accommodate Rav, why can we not establish the Seifa of this Mishnah too, when the finder saw the person drop them ... ?

(c) So we resolve the Kashya on Rav by quoting Rav's own interpretation of the Mishnah. Levi interprets 'Chatichos Mutaros' literally, to mean 'Mutaros ba'Achilah'.
What does Rav say?

(d) What are the ramifications of 'Mutaros Mishum Neveilah'?

Answers to questions

95b---------------------------------------95b

7)

(a) What did Rav, sitting on a bridge of the River Ishtatis, observe a man doing?

(b) What did the man do when the head fell into the water? What happened next?

(c) After exclaiming his surprise, what did Rav rule regarding the two heads?

(d) And what did he reply when Rav Kahana and Rav Asi asked him whether the second head was just as likely to have been Heter as Isur?

8)
(a) What do we try to prove from the above episode?

(b) Why is there no clear proof from there that Rav holds Basar she'Nis'alem min ha'Ayin is Asur?

(c) How do we prove that?

(d) What problem do we have with Rav's principle?

9)
(a) We initially answer that Rav would only eat meat immediately after the animal was Shechted.
What Heter, besides that of wrapping and sealing the meat, do we add that permitted him to eat even afterwards?

(b) How would Rabah bar Rav Huna mark his meat? Why did he do that?

10)
(a) What did Rav declare when, on his way to Rav Chanan, his son-in-law, he saw the ferry-boat coming towards him?

(b) What did he spy when, upon arriving home, he peeped through a crack in the door?

(c) What happened when he knocked at the door?

(d) What did he remark to the Shochtim?

11)
(a) Rav did not eat from that meat.
Why can it not have been ...
  1. ... on account of Basar she'Nis'alem min ha'Ayin?
  2. ... as a penalty for having divined, adding that would be a Yom-Tov in his house that night?
(b) This is based on a statement of Rav.
What did Rav say in defining Nichush?

(c) What was the Nichush of ...

  1. ... Eliezer Eved Avraham?
  2. ... Yonasan ben Shaul?
(d) We conclude that Rav declined to eat from that animal, because it was served at a Se'udas ha'Reshus, and Rav tended not to eat at a Se'udas Reshus.
What is a Se'udas ha'Reshus?
12)
(a) What do we mean when we say that ...
  1. ... Rav used to 'gauge with a ferry'? What did he gauge?
  2. ... Shmuel used to gauge with a Sefer?
  3. ... Rebbi Yochanan used to gauge with children?
(b) If, when Rebbi Yochanan would write to Rav in his lifetime, he would address his letters to 'our Rebbe in Bavel', how did he begin his letters to Shmuel, after Rav's death?

(c) How did Rebbi Yochanan react, when Shmuel sent him ...

  1. ... a list of leap years over the next sixty years? Why did he do that?
  2. ... thirteen camels laden with She'eilos concerning Tereifos?
(d) Why did Rebbi then decide to go and see Shmuel?
13)
(a) What did the child tell Rebbi Yochanan, when, on his way to visit Shmuel, he asked him to recite his Pasuk?

(b) If Shmuel had not really died, then why did they show Rebbi Yochanan that Pasuk?

(c) What did Rebbi Shimon ben Elazar mean when he said in a Beraisa ...

  1. ... 'Bayis, Tinok ve'Ishah ... Yesh Siman'?
  2. ... 'Af-al-Pi she'Ein Nichush'?
(d) What did Rebbi Elazar (ben P'das) prove from the Pasuk (in Miketz) "Yosef Einenu, ve'Shimon Einenu, ve'es Binyamin Tikachu, Alai Hayu Kulanah"?

(e) What did Ya'akov Avinu mean in that Pasuk?

14)
(a) What did Rav reply, when Rav Huna asked him whether meat on a string is a Siman to negate the Isur of Basar she'Nis'alem min ha'Ayin or not?

(b) What did he mean with his opening words '*Al T'hi Shoteh* ba'Charuzin ... '?

(c) How do others quote the ruling?

(d) Rav Nachman from Neherda'a had just arrived one Erev Yom Kipur in Pum Nahara, at the home of Rav Kahana, when he saw ravens drop livers and kidneys at a certain spot.
On what grounds did Rav Kahana permit him to eat them?

15)
(a) Rav Chiya bar Avin lost some Kark'sha (great intestines) among the barrels of wine. On what grounds did Rav Huna permit it when the owner later found it, even though he did not have a Siman by which to identify it?

(b) Likewise, Rav Nachman and Rav Chisda permitted a large chunk of meat and a ball of Techeiles to Rav Chanina Chuza'a and Rav Nasan bar Abaye, respectively, when they lost and subsequently found them.
Rav Huna follows the ruling of his Rebbe Rav who on principle, forbids Basar she'Nis'alem min ha'Ayin (and Rav Nachman and Rav Chisda too, agrees with that).
Why do we nevertheless permit Basar she'Nis'alem min ha'Ayin (in spite of Rav)?

(c) Who else in the Sugya disagrees with Rav?

(d) How do we reconcile this with the principle 'Hilch'sa ke'Rav'?
