Sukah 33

SUKAH 33 (Lag b'Omer) - Dedicated by Rabbi Yisroel Shaw in memory of his grandfather, Mr. Bernie Slotin (Dov Ber ben Moshe Mordechai z'l), whose soul ascended to its eternal resting place thirty days ago.

(a) The concept of Dichuy applies to many Halachos in the Torah where a certain object is required for a Mitzvah or Korban. Some examples are limbs and blood of the Korbanos, blood of Kosher birds and wild animals that must be covered with dirt, live animals for Korbanos and objects used to perform Mitzvos.
(b) The question of Dichuy with regard to objects used to perform Mitzvos applies in two instances: 1. the object was only fit for use *after* the time that the Mitzvah first applied ("Dichuy me'Ikara"); and 2. the object was fit for use at the time that the Mitzvah first applied, later became unfit, and afterwards became fit again ("Nir'eh v'Nidcheh"). In the latter case the Dichuy is stronger.
(c) At this stage of the Gemara, Rebbi Yirmeyah ponders whether or not we rule that once an object is unfit for a Mitzvah (Dichuy me'Ikara) it is forever suspended from being used for that Mitzvah. For example, the Hadas was unfit for use on Erev Yom Tov because of Niktam Rosho. On Yom Tov, an excretion in the shape of a date grew on the Hadas, covering the Rosh Katum. Is the Hadas now fit for use or not?

7) [line 25] LULAV EIN TZARICH EGED
(a) There is a Mitzvah to take four species on Sukos, as it states in the Torah (Vayikra 23:40). The four species are the Pri Etz Hadar (Esrog, citron), Kapos Temarim (Lulav, closed palm branch), Anaf Etz Avos (three Hadasim, myrtle branches) and Arvei Nachal (two Aravos, willow branches).
(b) There is an argument among the Tana'im as to whether three of the species (the Lulav, Hadasim and Aravos) must be tied together in an Eged (a bunch) in order to fulfill the Mitzvah. Those who rule that Lulav Tzarich Eged, learn this Halachah through a Gezerah Shavah between the verse of the four species and the verse of the Agudas Ezov (see Background to Sukah 11:13), using the word "u'Lekachtem" as the linking word. All opinions agree that l'Chatchilah the three species should be tied, since they look nicer that way (Gemara 11b).

There are certain Mitzvos for which a positive action must be done in order to prepare the object for the Mitzvah; the object cannot be prepared by default.

20) [line 26] DAVAR SHE'EIN MISKAVEN MUTAR
(a) A Davar she'Eino Miskavein is an act which is done for a certain purpose (which can be accomplished without transgressing an Isur Torah), but which *may* result in an Isur Torah being inadvertently performed. Rebbi Yehudah prohibits performing such an action, since it may result in an Isur Torah. Rebbi Shimon disagrees, claiming that even though an Isur Torah may result from this action, since the Isur Torah will come about without intent, the action is permitted.
(b) The laws of a Davar she'Eino Miskaven (that it is permitted according to Rebbi Shimon or forbidden according to Rebbi Yehudah) apply only when it is not inevitable that an Isur Torah will occur as a result of one's action. However, when an Isur Torah will definitely occur as a result of one's action, it is known as a Pesik Reshei and is forbidden. For example, if a person cut the head off of a chicken on Shabbos and states that he had no intention to kill the animal but he merely wanted its blood to feed to his dogs, it is considered as though he had full intention to kill the animal since it was an inevitable outcome of his act, and he is Chayav.
