Nazir 5

1) WHEN A NAZIR OLAM CUTS HIS HAIR

(a) Rebbi learns a Gezeirah Shaveh "Days-days" from a house in a walled city.
1. Just as there, "days" means 12 months - also, here.
(b) R. Nehorai says, he cuts his hair every 30 days; R. Yosi says, every Erev Shabbos, since this is the way of sons of kings.
(c) Question: How can Rebbi learn 12 months from the Gezeirah Shaveh - Rebbi says, "days" means 2 (the house may not be redeemed within 2 days)!
(d) Answer: The Gezeirah Shaveh teaches when his hair is too cumbersome - this is not after 2 days!
(e) Suggestion: Why not learn 2 years, from a Gezeirah Shaveh to "At the end of 2 years of days"?
(f) Answer: By Avshalom, it only says days, not years - it is better to learn from another such place, and not from "years of days".
(g) Suggestion: Why not learn 1 month, from a Gezeirah Shaveh to "Until a month of days"?
(h) Answer: It is better to learn "days" from "days", and not from "month of days".
(i) Suggestion: Why not learn (4 days a year) from a Gezeirah Shaveh to "Miyamim Yemimah (from days to days)"?
(j) Answer #1: It is better to learn "Yamim" from "Yamim", and not from "Yemimah".
1. Question: Why not?
i. (Tana d'Vei R. Yishmael): "The Kohen returns-the Kohen comes" - a Gezeirah Shaveh equates the laws.
2. Answer: If there is no better match, we may learn such a Gezeirah Shaveh; if there is a more similar word, we learn what is more similar.
(k) Answer #2: We cannot learn from there - we do not know if the 4 days were evenly spaced.
(l) (Beraisa - R. Nehorai): Once every 30 days.
1. Kohanim cut their hair this often, because after this it is too long - the same applies to a Nazir Olam!
(m) (Beraisa - R. Yosi): Every Erev Shabbos
(n) Question: If so, how was Avshalom different than his brothers?
(o) Answer #1: When Yom Tov fell during the week, his brothers would cut their hair on Erev Yom Tov, but he did not.
(p) Answer #2: His brothers could cut their hair in the morning, but he would only cut in the afternoon (after bringing the sacrifices - Rosh).
(q) Question: "At the end of 40 years" - starting from when?
(r) Answer (R. Nehorai): From when Yisrael asked for a king.
1. (Beraisa): The year they asked for a king was the 10th year of Shmuel's leadership over Yisrael.
2) UNSPECIFIED NEZIRUS IS 30 DAYS
(a) (Mishnah): Stam (unspecified) Nezirus is 30 days.
(b) Question: What is the source for this?
(c) Answer #1 (Rav Masna): "Yiheyeh (he will be) holy" - the numerical value of Yiheyeh is 30.
(d) Answer #2 (Bar Pada): This corresponds to the 29 times "Nazir" (or variant forms) appears in this passage of the Torah.
(e) Question: Why doesn't Rav Masna learn as Bar Pada?
(f) Answer: Some of them are expounded to teach laws, so we may not count such occurrences (we know that Stam Nezirus is 30 days - there are not enough remaining occurrences)!
1. "From wine and string drink Yazir" - this forbids wine of a Mitzvah just as optional wine.
2. "To vow a vow of Nezirus, to be a Nazir to Hash-m" - this teaches that if a Nazir accepts Nezirus, he must fulfill it when he finishes his current Nezirus.
5b---------------------------------------5b

(g) Defense of Bar Pada: Certainly, at least 1 of the 29 is not expounded. Since that one comes to teach the length of Stam Nezirus, all come for this.
(h) (Mishnah): Stam Nezirus is 30 days.
(i) Question: This is as Rav Masna, and refutes Bar Pada!
(j) Answer (on behalf of Bar Pada): Since he shaves and brings his sacrifices on the 30th day, the Tana considers the Nezirus to be 30 days.
(k) (Mishnah): One who said, 'I am a Nazir' - he shaves on the 31st day.
(l) Question: This fits well with Rav Masna - but according to Bar Pada, he should shave on day 30!
(m) Counter-question (Bar Pada): The end of the Mishnah says, if he shaved on day 30, he fulfilled the Nezirus!
1. The end of the Mishnah supports Bar Pada; the beginning of the Mishnah is a decree - we consider him to have accepted Nezirus for 30 full days.
(n) Question: How does Rav Masna explain the end of the Mishnah?
(o) Answer: He holds, part of the (30th) day conducted as a Nazir counts as the full day.
(p) Question (Mishnah): 'I am a Nazir for 30 days' - if he shaved (and brought the sacrifices of a Nazir) on the 30th day, he did not fulfill his vow.
(q) Answer: The case is, he said 30 full days (some texts read - it is as if he said 30 full days).
(r) (Mishnah): One who accepted to be a Nazir twice - he shaves (and brings sacrifices) for the 1st Nezirus on day 31; he shaves (and brings the sacrifices) for the 2nd Nezirus on day 61.
1. This fits with Rav Masna's opinion.
