1) WHOM A KOHEN GADOL MAY MARRY
(a) Question (Rav Ashi): But Rav and R. Yochanan say, he may
not marry a Bogeres or Mukas Etz - if he did marry them,
he is married!
1. He may stay married, since any girl he marries will
eventually become a Bogeres and Mukas Etz anyway.
2. We should also say, any girl he marries will become
a non-virgin as well!
i. This question is left difficult.
(b) Mishnah: He may not marry a woman raped or enticed by
another man - if he did marry them, R. Eliezer Ben Yakov
says, she son is a Chalal; Chachamim say, the son is
Kosher.
(c) Version #1: (Rav): The law is as R. Eliezer Ben Yakov.
(d) Version #2: Question (Rav): What is the reason of R.
Eliezer Ben Yakov?
(e) Answer #1 (Rav): He holds as R. Elazar (who says that a
woman becomes a Zonah for extramarital relations).
1. Question: This cannot be!
i. We hold, the Mishnayic teachings of R. Eliezer
Ben Yakov are few and clean (i.e. the law is
always as him).
ii. (Rav): The law is not as R. Elazar.
2. This is left difficult.
(f) Answer #2 (Rav Ashi): The Tana'im argue if a Chalal
results from Chaivei Ase.
1. R. Eliezer Ben Yakov says yes; Chachamim say, no.
2. R. Eliezer Ben Yakov learns from "A widow, divorcee,
Chalalah or Zonah, these he will not marry, but
rather a virgin ... he will not profane his seed" -
all these prohibitions profane his seed.
3. Chachamim say, the word "these" interrupts - only
those listed before this word profane his seed.
4. R. Eliezer Ben Yakov says, "these" is needed to
exclude a Nidah (that does not profane his seed).
(g) Question: As whom is the following?
1. (Beraisa): From these a Chalal is made, but not from
a Nidah.
(h) Answer: It is as R. Eliezer Ben Yakov.
(i) Question: According to R. Eliezer Ben Yakov, the word
"these" should have been written at the end (since all
listed prohibitions make a Chalal)!
1. This is left difficult.
2) WHEN DOES A KOHEN BECOME TAMEI FOR HIS SISTER?
(a) (Beraisa - R. Meir and R. Yehudah): His engaged sister -
he makes himself Tamei to bury her; R. Yosi and R. Shimon
say, he does not;
1. If she was raped or enticed, all agree he does not
make himself Tamei to bury her;
2. R. Shimon says, if she is a Mukas Etz, he does not
make himself Tamei to bury her.
i. R. Shimon says, he only makes himself Tamei for
a sister fitting to marry a Kohen Gadol.
3. All say, he makes himself Tamei to bury a Bogeres.
(b) Question: What is the reason of R. Meir and R. Yehudah?
(c) Answer: "To his virgin sister" - to exclude one that was
raped or enticed.
1. Suggestion: Perhaps we should exclude even a Mukas
Etz?
2. Rejection: "That was not (married) to a man" - one
whose "being" (loss of virginity) was through a man,
to exclude a Mukas Etz.
(d) "That is close" - to include an engaged sister.
(e) "To him" - to include a Bogeres.
(f) Question: Why must a verse teach this? R. Meir holds,
"virgin" includes one that has some tokens of virginity!
(g) Answer: We would have thought to learn from there (Rashi
- a virgin that is raped; Tosfos - from a girl fit for a
Kohen Gadol), where she must be a Na'arah; the verse
teaches us not to.
(h) Question: How do R. Yosi and R. Shimon learn?
(i) Answer: "To his virgin sister" - to exclude one that was
raped or enticed and a Mukas Etz.
1. "That was not (married)" - to exclude an engaged
sister.
2. "That is close" - to include a sister that was
engaged and divorced.
3. "To him" - to include a Bogeres.
i. Question: "That is close" - to include a sister
that was engaged and divorced - but R. Shimon
says, he only makes himself Tamei for a sister
fitting to marry a Kohen Gadol!

ii. Answer: This case is different - the Torah said
"close" to include it.
iii. Objection: We should also say by Mukas Etz, the
Torah said "close" to include it!
iv. Answer: It comes to include one case, not 2.
v. Question: Why say it includes a sister divorced
from engagement, and not a Mukas Etz?
vi. A physical act happened to the Mukas Etz, but
not to the divorced sister.
(j) Question: R. Yosi did not say the law of Mukas Etz with
his partner (R. Shimon) - he must hold as R. Meir - how
does he learn?
(k) Answer: "That was not to a man", includes a Mukas Etz.
(l) Objection: But he already uses that verse (to exclude an
engaged sister)!
(m) Answer: We learn Mukas Etz from "Was not"; "to a man"
includes an engaged sister.
(n) Question: R. Shimon says that "virgin" implies having all
tokens of virginity (why does he need a verse to include
Bogeres - he should learn from the fact that a Kohen
Gadol may marry a Bogeres)!
(o) Answer: He only learned that from our verse.
1. Since the Torah had to write "To him" to include a
Bogeres, we learn that "virgin" implies a full
virgin.
3) ARE ANY CONVERTS PERMITTED TO A KOHEN?
(a) (Beraisa - R. Shimon Bar Yochai): A girl that converted
when at most 3 years may marry a Kohen - "All young girls
that have not had relations, keep alive for yourselves" -
and Pinchus was among the fighters permitted to these
women!
(b) Chachamim: "Keep alive for yourselves" - as slaves.
1. Question: If so, even if they are above 3, they
should be kept alive!
2. Answer: As Rav Huna taught.
i. Contradiction (Rav Huna): It says, "All women
that have had relations with a man, kill" -
implying, women that did not have relations
should be kept alive; we also deduce, young
girls are kept alive whether or not they had
relations.
ii. Another verse says, "All young girls that did
not have relations, keep alive for yourselves"
- implying, if they did have relations, they
are killed!
iii. Answer (Rav Huna): Both verses say that any
girl old enough to have relations is killed.
iv. Support (Beraisa): "All women that have had
relations with a man" - the verse speaks of a
woman old enough to have relations;
A. Question: Perhaps it means that actually had
relations?
B. Answer: Another verse says, "All young girls
that did not have relations" - we see, the
Torah talks of being fit for relations.
v. Question: How did they know which girls were
fit for relations?
vi. Answer (Rav Huna Bar Bizna): They passed the
girls in front of the Tzitz (an ornament of the
Kohen Gadol). One whose face turned green was
known to be fit for relations; if she did not
turn green, she was not fit.
vii. (Rav Nachman): The face turning green is a sign
of sin.
(c) "Among the dwellers of Yavesh Gilad were found 400 virgin
Na'aros that did not have relations."
(d) Question: How did they know?
(e) Answer (Rav Kahana): They sat each on a barrel of wine.
The smell of the wine would pass through a non-virgin,
but not through a virgin.
(f) Question: Why didn't they pass them in front of the
Tzitz?
(g) Answer (Rav Kahana Brei d'Rav Noson): "(The Tzitz is) to
make acceptable for them" - not for punishments.
(h) Question: If so, it should not have been used by the
captured Midianites!
(i) Answer (Rav Ashi): For them (Yisrael) it makes
acceptable, not for punishments - for Nachrim, even for
punishments.
(j) (R. Yakov Bar Idi): R. Yehoshua Ben Levi said, the law is
as R. Shimon Bar Yochai.
1. R. Zeira: Did you hear this explicitly, or did you
derive it?
i. Question: How could this be derived?
ii. Answer: R. Yehoshua Ben Levi said, protests
were made in a city in Eretz Yisrael. Rebbi
sent R. Rumnus to check; he found a girl that
converted before 3; Rebbi permitted her to
Kehunah.
2. R. Yakov Bar Idi: I heard it explicitly.
3. Question: Had it been derived, what objection could
be raised?
4. Answer: Perhaps once she was married, we would be
lenient.
i. Support (Rav and R. Yochanan): A Kohen Gadol
should not marry a Bogeres or Mukas Etz - if he
married her, he is married.
5. Rejection: That is no support - there, whomever he
will marry will become a Bogeres and a non-virgin
during the marriage; here, is a Kohen's wife
standing to become a Zonah during the marriage?
(k) Rav Safra derived the ruling, had the question, and
answered as said above.
(l) A Kohen was married to a girl that converted before 3
years.
1. Rav Nachman Bar Yitzchak: Why did you marry her?
2. The Kohen: R. Yakov Bar Idi said that R. Yehoshua
Ben Levi said that the law is as R. Shimon Bar
Yochai!
3. Rav Nachman Bar Yitzchak: Divorce her, or I will
remove (your reliance on) R. Yakov Bar Idi from you
(i.e. I will excommunicate you, and you will be
forced to divorce her).
