Nidah 73

Questions

1)

(a) We know that if a woman has three consecutive sightings during the days of Nidus that she does not become a Zavah, from "be'Lo Es Nidasah".

(b) We learn that a woman becomes a Zavah even when she sees three times from the fifth day through the tenth, because, just like the fourth day, those days are fit to be included both in the three days of sighting and in the seven clean days that follow her sighting of the first, second and third days.

(c) We might therefore have thought, that if she sees on the ninth, the tenth and the eleventh, she will not be a Zavah Gedolah, since the eleventh day is not fit to combine with the previous day, to make up the seven clean days that follow her sighting of the first three days.

(d) We include the eleventh day (in the days that make her a Zavah Gedolah) however, from "be'Lo Es Nidasah", which implies any day which is not within the days of Nidus.

2)
(a) We exclude the twelfth day from making her a Zavah Gedolah, because, unlike the eleventh, it is unfit to count as a clean day (seeing as it is a day of Nidus).

(b) We learn from "Kol Yemei" that even two sightings - and even one - in the days of Zivus renders her Temei'ah (though not a Zavah).

3)
(a) From "Hi" we learn that a Zavah renders her Bo'eil Tamei, but not a Zav.

(b) We would have said that if a Zavah, who does not become a Zavah when she sees three times on one or two consecutive days, is Metam'ah her Bo'eil, then a Zav, who does, should most certainly be Metamei the woman that he is Bo'eil!

(c) From "Kol Yemei" written by Mishkav and Moshav, we learn that if a woman sees even just once or twice during her days of Zivus, she is Metamei Mishkav and Moshav.

4)
(a) We would have learnt a Kal va'Chomer from a Zav, who does not need to keep one clean day when he sees Zivus once, yet he must keep seven clean days when he sees twice; a Zavah, who does have to keep one clean day when she sees once, should certainly be obligated to keep *seven* clean days when she sees twice.

(b) "Yiyhe Lah" teaches us that she only counts one day for the first sighting, and another day for her second one.

5)
(a) The author of the Beraisa which cites the source for the Hilchos Zivus as being Halachah le'Moshe mi'Sinai, is Rebbi Elazar ben Azarya; and we have already seen that Rebbi Akiva disagrees with him regarding the Log of oil of a Todah. He also disagrees with him regarding the Dinim of Zivus - which, according to Rebbi Elazar ben Azarya, are Halachah, but according to him, they too, are derived from Pesukim.

(b) From "Al Nidasah", we learn that even if she sees at night-time, immediately after the termination of her days of Zivus, she still becomes a Zavah -and not only if she sees three times during the day (because the Torah writes "Shiv'as Yamim").

6) We learn from "Halichos Olam Lo", that someone who learns Halachos (Mishnah, Beraisa, or Halachah le'Moshe mi'Sinai) every day is assured of a place in the World to Come. This is because we read the word not as "Halichos", but 'Halachos'.
