Nedarim 68
NEDARIM 68 (25 Elul) - dedicated by Mrs. G. Turkel (Rabbi
Kornfeld's grandmother), an exceptional woman with an iron
will, who loved and respected the study of Torah. Today is the
Shloshim following her passing. Tehei Nafshah Tzerurah
bi'Tzror ha'Chaim.

1) THE SOURCE THAT THEY ANNUL TOGETHER
(a) (Beraisa - Tana d'Vei R. Yishmael): "Between a man and
his wife, between a father and his daughter" - this
teaches that both must annul the vow.
(b) Question: What does he learn from "If she will be to a
man"?
(c) Answer: He learns Rava's other law (equating vows before
the 1st marriage to vows before the 2nd marriage).
(d) Question: (Rava learned joint annulment from "If she will
be to a man" - what does Rava learn from the verse Tana
d'Vei R. Yishmael expounded ("Between a man and his wife,
between a father and his daughter")?
(e) Answer: To teach that a husband annuls vows that affect
relations with his wife.
2) ANNULMENT OF 1 PARTNER
(a) Question: When an engaged husband annuls alone, does he
cut half the vow (but the remainder is a full-strength
vow); or, does he weaken the vow?
1. For example - she vowed from 2 olives, her husband
annulled the vow, and she ate the olives.
i. If he cuts the vow (and does not weaken it),
she is lashed;
ii. If he weakens it, she is not lashed.
(b) Answer (Beraisa): (The answer is from the end of the
Beraisa, 69A) When do we say, that if the husband dies,
the father receives authority to annul her vow? When the
husband died without hearing the vow, or after he
annulled it, or if he died on the day he heard it, before
he acted on it;

(c) But if the husband affirmed the vow, or was silent on the
day he heard it and died on a later day, the father
cannot annul it.
(d) If the father heard her vow and annulled it and died
before the husband heard it, authority to annul her vow
does not pass to the husband.
(e) If the husband heard her vow and annulled it and died
before the father heard it, authority to annul her vow
passes to the father.
(f) If the husband heard her vow and annulled it and the
father died before hearing it, the husband cannot annul
it, since he can only annul in partnership.
