***** PEREK KOL KINUYEY *****
1) MISHNAH: KOL KINUYEY
(a) Kinuyim (slang) for Nedarim, Charamim, Shevuos, and Nezirus are
binding.
(b) Yados (shorthand), such as "I make a neder on eating any food of
yours" (but without saying that it is forbidden like a korban),
are binding.
1. This is with terms such as Mudrani, Mufreshani, Meruchkani.
(c) (R. Akiva) The term "Menudeh" is also likely to be binding.

2) THE CONTENTS OF THE MISHNAH
(a) Question: Why, unlike in the Mishnah of Nazir, did this Mishnah
list all different types of vows?
(b) Answer: Shavuah was listed because it is adjacent to Neder in the
Torah, and once the Mishnah was listing two types, it added the
rest.
(c) Question: Shavuah should therefore also be adjacent to Neder in
the Mishnah!?
(d) Answer: Cherem was placed next to Neder because they are both
prohibitions on the object, unlike Shavuah which places the
prohibition on the person.
3) THE ORDER OF THE MISHNAH
(a) Question: Why did the Mishnah list Kinuyim first, but explain
Yados first?
(b) Question #2: Why did the Mishnah leave out the basic law of
Yados?
(c) Answer to #2: Emend it such that the law of Yados is listed after
Kinuyim.
(d) Question: Why not explain the laws of Kinuyim before that of
Yados?
(e) Answer: It explains the latter law first, as we find elsewhere.
(f) Question: But there are also places where it explains the former
law first!?
(g) Answer: Only where there are many examples of the laws, does it
explain the former laws first.
(h) Question: Surely the law of which items animals may carry on
Shabbos do not have many examples, yet the former laws are listed
first!?
