Nazir 59
1) SHAVING THE UNDERARMS AND THE GENITALS
(a) Version #2 (R. Chiya bar Aba): One who shaves his
underarms or his genitals is lashed, for it says "A man
will not wear the garment of a woman".
(b) Question (Beraisa): Removing hair (in these areas) is
only forbidden mid'Rabanan.
(c) Answer: R. Chiya bar Aba holds as the following Tana.
1. (Beraisa): One who shaves his underarms or his
genitals transgresses "A man will not wear the
garment of a woman".
(d) Question: The Tana that says that the prohibition is only
mid'Rabanan - how does he expound "A man will not wear
the garment of a woman"?
1. Answer (Beraisa): "The garment of a man will not be
on a woman" - what does this teach?
i. Suggestion: If that a man should not wear a
woman's garment or vice-versa - but the Torah
called this an abomination (and this is not an
abomination)!
2. Answer: Rather, a man should not wear a woman's
garment and sit among women, or vice-versa;
3. R. Eliezer ben Yakov says, "The garment of a man
will not be on a woman" - this teaches that a woman
may not bear weapons in war;
4. "A man will not wear the garment of a woman" - this
teaches that a man may not adorn himself as a woman
does.
(e) (Rav Nachman): A Nazir may shave the underarms and
genital area.
1. The law is not as Rav Nachman.
(f) Question (Chachamim): We saw, R. Yochanan does not have
hair there!
(g) Answer (R. Shemen bar Aba): It fell out due to old age.
(h) R. Ami sentenced a man to be lashed. His underarms were
exposed, and R. Ami saw that he did not shave there.
1. R. Ami: Do not lash him - he is a Chacham.
(i) Question (Rav): May one shave there?
(j) Answer (R. Chiya): No.
(k) Objection (Rav): But the hair will grow to annoy him - he
is not shaving for adornment!
(l) Answer (R. Chiya): No - when the hair gets too long, it
falls out.
(m) Question (Rav): May one scratch there so the hair will
fall out?
(n) Answer (R. Chiya): No.
(o) Version #1 Question (Rav): May one scratch through a
garment?
(p) Answer (R. Chiya): Yes.
(q) Version #2 Question (Rav): May one scratch through a
garment during prayer (to remove a louse)?
(r) Answer (R. Chiya): No.
1. The law does not follow the opinion of R. Chiya.

2) A DOUBTFULLY TAMEI NAZIR
(a) (Mishnah): 1 of 2 Nezirim became Tamei (we do not know
which); 1 of them died. R. Yehoshua says, the survivor
should find someone willing to accept Nezirus on
condition.
1. The Nazir says: 'If I am Tamei, you are a Nazir
starting now; if I am Tahor, you will be a Nazir
after 30 days.
2. They keep 30 days of Nezirus. They bring (together)
sacrifices of a Tamei Nazir and the sacrifices of a
Tahor Nazir. The original Nazir stipulates: if I was
Tamei, the sacrifices of a Tamei Nazir are for me,
the sacrifices of a Tahor Nazir are for you; if I
was Tahor, the sacrifices of a Tahor Nazir are for
me, the sacrifices of a Tamei Nazir were brought
because of the doubt.
3. They keep another 30 days of Nezirus. They bring
(together) the sacrifices of a Tahor Nazir. The
original Nazir stipulates: if I was Tamei, these
sacrifices are for me; if I was Tahor, these
sacrifices are for you.
(b) Ben Zoma says, who will consent to accept Nezirus on such
conditions?!
1. Rather, the surviving Nazir brings (after 30 days) a
bird as a sin-offering and an animal as a
burnt-offering. He stipulates: if I was Tamei, I
fulfill my obligation with the sin-offering, and the
burnt-offering is a voluntary sacrifice; if I was
Tahor, I fulfill my obligation with the
burnt-offering, and the sin-offering was brought
because of the doubt.
2. He keeps another 30 days of Nezirus and brings the
sacrifices of a Tahor Nazir. He stipulates: if I was
Tamei, I fulfill my current obligation (of a Tahor
Nazir) with these sacrifices;
3. If I was Tahor, I already fulfilled my obligation to
bring a burnt-offering; the current burnt-offering
is a voluntary offering, and the other sacrifices I
bring to complete the obligatory sacrifices of a
Tahor Nazir.
(c) Objection (R. Yehoshua): (If he was Tahor,) he does not
bring his obligatory sacrifices at one time!
1. Chachamim agreed to Ben Zoma.
(d) (Gemara) Question: So what if he does not bring his
obligatory sacrifices at one time?!
(e) Answer (Rav Yehudah): Even R. Yehoshua admits, this is
fine; he only said otherwise to sharpen his Talmidim and
train them to ask questions.
(f) Question (Rav Nachman): According to R. Yehoshua, how do
we prevent the Chelev from congealing until it can be
offered on the Altar (after they finish shaving)?
