Nazir 44

1) BECOMING TAMEI FROM CONTACT WITH AN INCOMPLETE CORPSE

(a) Suggestion: Perhaps he cannot become Tamei for a spine, skull, or the majority of the stature or bones of other relatives.
(b) Rejection: Just as he can become Tamei for these parts of his sister, also regarding other relatives he is commanded to bury.
(c) Answer: This Beraisa also holds as R. Yehudah; Rav holds as the following Tana.
1. (Beraisa): It occurred that R. Yitzchak's father died in Ninzak; he only heard 3 years later. R. Yehoshua ben Elisha and 4 Chachamim expounded "To his father" - he may only become Tamei for a complete corpse.
2) THE STRINGENCIES OF EACH PROHIBITION OF A NAZIR
(a) (Mishnah): There are 3 prohibitions of a Nazir: Tum'ah, shaving, and consuming what comes from the vine.
1. There is a stringency of Tum'ah and shaving which does not apply to eating of the vine - if a Nazir became Tamei or shaved, he (usually) must guard additional days of Nezirus, but not if he ate from the vine.
2. There is a stringency of eating of the vine which does not apply to Tum'ah and shaving - eating from the vine is never permitted to a Nazir, but Tum'ah and shaving are permitted, for the Mitzvah of shaving (of a leper) and a Mes Mitzvah.
3. There is a stringency of Tum'ah which does not apply to shaving - Tum'ah totally nullifies all days guarded until then, and obligates him to bring sacrifices, but shaving does not nullify more than 30 days, and does not obligated him to bring sacrifices.
(b) (Gemara) Suggestion: A Kal va'Chomer should teach that Tum'ah is never permitted to a Nazir!
1. Drinking wine does not nullify days guarded, and it is never permitted - Tum'ah, which nullifies, all the more so it should never be permitted!
(c) Rejection: "To his father and mother he will not become Tamei" - but he may become Tamei to a Mes Mitzvah.
(d) Suggestion: A Kal va'Chomer should teach that wine is sometimes permitted to a Nazir!
1. Even though Tum'ah nullifies days guarded, it is sometimes permitted - drinking wine, which does not nullify, all the more so it should be permitted!
(e) Rejection: "From wine and strong drink he will refrain" - this prohibits wine of a Mitzvah just as wine which is not a Mitzvah.
(f) Suggestion: A Kal va'Chomer should teach that drinking wine nullifies days guarded!
1. Tum'ah is sometimes permitted, and it nullifies - drinking wine, which is never permitted, all the more so it should nullify!
(g) Rejection: "The first days will fall, because he became Tamei" - Tum'ah nullifies, but not drinking wine.
(h) Suggestion: A Kal va'Chomer should teach that shaving nullifies all days counted!
1. Even though the Torah only punishes a Nazir that became Tamei, not one who made him Tamei, still, Tum'ah nullifies all days guarded - shaving, by which the Torah punishes one who shaves a Nazir just as a Nazir that is shaved, all the more so it should nullify all days guarded!
(i) Rejection: "The first days will fall, because he became Tamei" - Tum'ah nullifies all days, but shaving does not.
(j) Suggestion: A Kal va'Chomer should teach that the Torah punishes one who makes a Nazir Tamei!
1. Shaving only nullifies 30 days, and yet the Torah punishes one who shaves a Nazir just as a Nazir that is shaved - by Tum'ah, which nullifies all days counted, all the more so, one who makes a Nazir Tamei should be punished!
(k) Rejection: "He made his head Tamei" - the Torah only punishes the one who made himself Tamei.
(l) Suggestion: A Kal va'Chomer should teach that the Torah does not punish one who shaves a Nazir!
1. Tum'ah nullifies all days counted, and yet the Torah does not punish one who makes a Nazir Tamei - by shaving, which only nullifies 30 days, all the more so, one who shaves a Nazir should be exempt!
(m) Rejection: "Will not Ya'avor a razor on his head" - the word can be read "Ya'avor (the Nazir will not pass)" and "Ya'avir (another person will not pass)".
(n) Suggestion: A Kal va'Chomer should teach that shaving is never permitted to a Nazir!
1. Drinking wine does not nullify days guarded, and it is never permitted - shaving, which nullifies, all the more so it should never be permitted!
(o) Rejection: The Torah said "His head" and "His beard", to teach that the Mitzvah of a leper to shave overrides the prohibitions of shaving the beard and a Nazir shaving his head.
(p) Suggestion: A Kal va'Chomer should teach that shaving does not nullify any days!
1. Drinking wine is never permitted, but still, it does not nullify days guarded - shaving, is sometimes permitted, all the more so it should not nullify!
(q) Rejection: We require the Nazir to shave at the end of Nezirus with grown hair, and if he shaved within 30 days, he lacks this!
(r) Suggestion: A Kal va'Chomer should teach that drinking wine nullifies 30 days!
1. Shaving is sometimes permitted, yet it nullifies 30 days - drinking wine, which is never permitted, all the more so, it should nullify 30 days!
(s) Rejection: Shaving only nullifies 30 days because the Nazir must shave 30 days growth of hair - even if he drank wine, his hair is intact!!

3) THE SHAVING OF A TAMEI NAZIR

(a) (Mishnah): The shaving of a Tamei Nazir: he is sprinkled with the purifying water on days 3 and 7; he shaves on day 7, and brings sacrifices on day 8; R. Akiva says, if he shaved on day 8, he may bring sacrifices that same day;
(b) R. Tarfon: Why (Tosfos; Rashi - how) is this different than a leper?
(c) R. Akiva: A Tamei Nazir's purification depends on days; a leper's purification depends on shaving, and he cannot bring sacrifices until the day after purification.
(d) (Gemara) Question: Did R. Tarfon accept R. Akiva's answer?
(e) Answer (Beraisa - Hillel): If (a Nazir) shaved on day 8, he brings sacrifices on day 9.
1. If R. Tarfon accepted the answer, all would agree that sacrifices are brought on day 8!
(f) Rejection (Rava): We can say, he accepted the answer - in the Mishnah, the Nazir immersed on day 7; in the Beraisa, he did not (until day 8).
(g) (Abaye): Friends of R. Noson bar Hoshaya expounded: "(A Zav (a man that had emissions) on the day he brings sacrifices) will come in front of Hash-m to the opening of the tent of meeting (Mishkan) and give them to the Kohen" - he cannot come on the day of immersion, only on the morrow.
1. They must hold, on the day a Zav immerses, he is still as a Zav (and is therefore unable to bring his sacrifices).
2. Question (Abaye): According to this, you should similarly expound "(A Tamei Nazir will bring sacrifices) to the opening of the tent of meeting" - he can only come on the day after immersing.
