Nazir 20

1) NEZIRUS OUTSIDE OF YISRAEL

(a) Rejection: No - all agree, the decree was on the soil (Tosfos - on the airspace).
1. Beis Shamai hold, the Nazir was fined to conduct standard Nezirus in Eretz Yisrael; Beis Hillel hold, he was fined to start over.
(b) (Mishnah): There was a case with Queen Hilni ...
(c) Question: Does R. Yehudah hold that she became Teme'ah, according to Beis Shamai; or she did not become Teme'ah, according to Beis Hillel?
(d) Answer (Mishnah): At the end of the 7 years, she came up to Eretz Yisrael. Beis Hillel ruled that she must be a Nazirah for 7 more years.
1. If you will say that she became Teme'ah, according to Beis Shamai - why does R. Yehudah say she was a Nazirah for only 14 years - she would have been for 14 years and 30 days!
(e) Support (Beraisa): R. Yehudah says according to R. Eliezer, "This is the law of a Nazir" - if he becomes Tamei on the day of completion, his law is as a standard Nazir.
2) CONTRADICTORY TESTIMONY REGARDING NEZIRUS
(a) (Mishnah): 2 pairs of witnesses testify about Reuven. 1 says that he accepted 2 terms (Rashi - years) of Nezirus; the other says that he accepted 5.
(b) Beis Shamai say, there is a contradiction in the testimony, we do not force Reuven to be a Nazir;
(c) Beis Hillel say, the witnesses that say 5 agree that he accepted at least 2 - he must be a Nazir twice.
(d) (Gemara): Our Mishnah is unlike the following Tana.
1. (Beraisa - R. Yishma'el, son of R. Yochanan ben Berokah): When there are 2 sets of witnesses, 1 set says 2, the other says 5, Beis Shamai agree that he must be a Nazir twice;
2. They argue when there is one set of witnesses, one witness says 2, the other, 5.
i. Beis Shamai say, there is a contradiction in the testimony, we do not force Reuven to be a Nazir;
ii. Beis Hillel say, the one who says 5 agrees that he accepted at least 2 - he must be a Nazir twice.
(e) (Rav): All agree when they count out the Neziruyos.
(f) Question (Rav Chama): What is Rav saying?
1. Suggestion: If 1 witness says he accepted 5 and not 2, and the other says 2, not 5 - they contradict each other!
(g) Answer: Rather, 1 says he accepted '1, 2'; the other says he accepted '3,4,5'.

(h) Objection: Why must this be taught?
1. Rav said that all agree (that the testimony is nullified) when they count the Neziruyos by the severe case (of 2 pairs of witnesses) - must he also teach this by the lenient case (of 1 witness pair)?!
(i) (Tosfos' text reads: Objection: Why is this considered contradictory testimony?
1. The witness that says 5 - does he not admit to 2?!)
(j) Chachamim in Eretz Yisrael say that when they count, this is not considered contradiction.

3) ACCEPTING TO BE AS ANOTHER NAZIR

(a) (Mishnah): Reuven said 'I am a Nazir'; another heard, and said 'And I'; (another heard and said) 'And I' - they are all Nezirim.
1. If the 1st annulled his Nezirus, the Nezirus of all of them is annulled; if the last annulled his Nezirus, he is not a Nazir, the rest of them are Nezirim.
(b) Reuven said 'I am a Nazir'; Shimon heard, and said 'My mouth is as his mouth', or 'My hair is as his hair' - Shimon is also a Nazir.
(c) Reuven said 'I am a Nazir'; his wife heard and said 'And I' - Reuven can annul her Nezirus, and he is still a Nazir.
(d) Leah said 'I am a Nazirah'; her husband heard, and said 'And I' - he cannot annul her Nezirus.
(e) Reuven said to his wife 'I am a Nazir - and you?' She replied 'Amen' - Reuven can annul her Nezirus, and he is still a Nazir.
(f) Leah said to her husband 'I am a Nazirah - and you?' He replied 'Amen' - he cannot annul her Nezirus.
(g) (Gemara - Reish Lakish): All must say 'And I' within the time of speech.
1. Question: What is the time of speech?
2. Answer: The time needed to greet.
3. Question: What is the time needed to greet?
4. Answer: The time needed for a Talmid to greet his Rebbi.
(h) Objection (R. Yehudah Nesi'ah): This does not leave room for the Talmid (to greet his Rebbi and accept Nezirus)!
