Gitin 66

GITIN 66 & 67 - Anonymously dedicated by an ardent supporter who wants the Zechus of spreading Torah throughout the world.

1) [line 1] DARA REBBI AVINA L'SILTEI - Rebbi Avina carried his sack (of food for the road)

2) [line 11] MATNAS SHECHIV ME'RA B'MIKTZAS HI
(a) A Shechiv Mera is a person lying on his deathbed. Normally, in order to transfer one's possessions to someone else, a proper Kinyan must be executed (see Background to Gitin 13:7), which will later be written in a Shtar. The Chachamim instituted that a Shechiv Me'ra may effect a Kinyan and transfer his property by simply requesting verbally that the transfer take place. If he recovers, the Kinyan is not valid, because it is clear that he executed the Kinyan only because he thought that he was going to die.
(b) However, if the Shechiv Me'ra gives as a gift only a portion of his property ("Matanah b'Miktzas"), then the transaction does *not* take effect until he makes a formal Kinyan. The reason is because by keeping some of his property to himself, he shows that he expects to live and is not giving away his property because he anticipates dying, and thus his gift has the status as that of a healthy person and it requires a Kinyan to take effect.

16) [line 9] BEIS DIN HA'GADOL SHEB'YRUSHALAYIM - the Beis Din of the Lishkas ha'Gazis (the Jewish Supreme Court), known as the Great Sanhedrin of 71 judges. The Lishkas ha'Gazis (The Chamber of Hewn Stone) was partially built in the Azarah of the Beis ha'Mikdash. The Great Sanhedrin was the highest Halachic authority before which the most difficult cases were brought (Devarim 17:8).

17) [line 17] TETZEI - if the woman married another man based on this Get, she must get divorced (literally "she must leave" him) due to the doubtful validity of the Get.

18) [line 19] U'MESAPKA LEI, MILEI, IY MIMSERAN L'SHALI'ACH - and he is in doubt whether "Milei" can be given over to a Shali'ach
(a) It is possible to make a Shali'ach (an agent) to establish all Kinyanim (acquisitions; the word "Kinyan" connotes a change of ownership or status, such as sales, gifts, Gitin and Kidushin). The Gemara states, "Shelucho Shel Adam Kemoso," i.e. [the act performed by] the Shali'ach of a person is like [an act performed by the person] himself (Kidushin 41b).
(b) A Shali'ach can appoint another Shali'ach in his place, as long as the person who sent him has no objections. The Gemara explains that this only applies if the Shali'ach was given an *object* with which he was expected to effect a Kinyan (e.g., if the Shali'ach was given a Get to deliver to the person's wife). If the Shali'ach only received verbal instructions ("Milei") to execute, however, his appointment is not considered authoritative enough for the Shali'ach to appoint another Shali'ach.
