Since the buyer does not accept responsibility for the loss of the produce, when he gives the money to the seller it looks like a loan (since the seller -- no matter what happens -- later must return that money, or produce worth that money, to the buyer). If the produce, on the other hand, increases in value, then the sale remains valid, and the increase in value that the buyer receives is considered like Ribis. Such a case is prohibited mid'Rabanan (Bava Metzia 70a).
